As a result, employers are free to set their own <a href=\"https:\/\/factorialhr.com\/blog\/vacation-payout\/\" target=\"_blank\" rel=\"noopener\">vacation payout<\/a> and <a href=\"https:\/\/factorialhr.com\/blog\/pto-carry-over\/\" target=\"_blank\" rel=\"noopener\">PTO carry over<\/a> policies. However, employers can <strong>limit the amount of vacation time an employee can accrue<\/strong> during the year.<\/p>\n<h3><strong>Roll over<\/strong><\/h3>\n<p>Employers in Pennsylvania are <strong>not required to allow employees to roll over vacation time.<\/strong> However, many employers do, subject to certain restrictions.<\/p>\n<p>Here are some <strong>common restrictions<\/strong> that employers impose on vacation rollover:<\/p>\n<ul>\n<li>Employees can only roll over a <strong>certain number of days<\/strong> of vacation time.<\/li>\n<li>Employees can only roll over vacation time <strong>from one year to the next.<\/strong><\/li>\n<li>If an employer does allow employees to roll over vacation time, the employer must have a <strong>written policy that outlines the restrictions on vacation rollover.<\/strong> The policy must be given to employees in writing at the time of hire or at the time that the policy is adopted.<\/li>\n<\/ul>\n<h3><strong>Payment of accrued, unused vacation on termination<\/strong><\/h3>\n<p>In the event of termination, the state <strong>does not mandate PTO payout.<\/strong> Employers are not legally required to provide vacation pay or compensate employees for unused vacation time, <strong>unless it is specified in a company policy or employment contract.<\/strong><\/p>\n<h2><strong><a name=\"pay\"><\/a>Is holiday pay mandatory in Pennsylvania?<\/strong><\/h2>\n<p>Whether an employer in Pennsylvania offers holiday pay or <a href=\"https:\/\/factorialhr.com\/blog\/unpaid-time-off\/\" target=\"_blank\" rel=\"noopener\">unpaid time off<\/a> depends on a number of aspects. Generally speaking, the amount of <a href=\"https:\/\/factorialhr.com\/blog\/paid-time-off-usa\/\" target=\"_blank\" rel=\"noopener\">paid time off<\/a> can vary based on factors such as the industry, location, and the employee\u2019s length of service with the company.<\/li>\n<li>Finally, according to the FLSA, private employers must pay non-exempt employees <strong>time and a half<\/strong> for any hours worked on a federal holiday. If you have fewer than 25 employees, you do not have to pay your employees for the hours they work on state-recognized holidays.
