This includes <strong>employment, housing and public spaces<\/strong>. Specifically, according to the FCRA, discrimination is defined as includes <strong>any form of unfair treatment that is based on race, color, religion, sex, pregnancy, national origin, age, handicap, or marital status<\/strong>.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Key provisions<\/strong> of this law related to the workplace include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Equal employment opportunities<\/strong>. Firstly, employers must make sure that all applicants and employees have equal access to job opportunities, promotions and benefits without discrimination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Workplace harassment<\/strong>. Secondly, employers must identify and address any claims of workplace harassment in Florida that could potentially create a hostile work environment.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Disability accommodations<\/strong>. Thirdly, employers must provide reasonable accommodations for employees with disabilities, provided it does not negatively impact business operations. For example, if an employee has a hearing disability, then you cannot force them to use the phone. Instead, you should accommodate their work so that it can be done via email instead. Or if an employee uses a wheelchair, then you cannot require them to do manual labor.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong>Sexual harassment<\/strong>. Finally, under the FCRA, employees have a right to work in an environment that is free from unwelcome sexual advances, requests for sexual favors, or verbal or physical conduct of a sexual nature that interferes with their work performance or creates an intimidating, hostile or offensive work environment.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">This state law is complemented by federal laws including Title VII of the Civil Rights Act of 1964.<\/span><\/p>\n<h3><b>Title VII of the Civil Rights Act of 1964<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Most employment contracts in the US are \u201c<strong>at-will<\/strong>\u201d. This means that an employer can dismiss an employee <strong>without notice<\/strong> and without having to establish \u201cjust cause\u201d for termination. The only exception to this is if the reason for termination is understood as being illegal.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of the most common forms of illegal termination relates to <strong>discrimination<\/strong>. This is where you <strong>dismiss an employee as a direct result of their gender, sexual orientation, race, religion, or disability status<\/strong>. And this protection has been made possible thanks to <strong>Title VII<\/strong>.<\/span><\/p>\n<p><a href=\"https:\/\/factorialhr.com\/blog\/title-vii\/\"><span style=\"font-weight: 400;\">Title VII of the Civil Rights Act<\/span><\/a><span style=\"font-weight: 400;\"> is a <strong>federal law<\/strong> that prohibits employment discrimination and harassment based on race, color, religion, sex (including gender, pregnancy, sexual orientation, and gender identity), and national origin. Title VII specifically prohibits <strong>discrimination in the terms and conditions of employment<\/strong>, including hiring, compensation, employment benefits, advancement, employment training, assignments, and termination of employment. Moreover, Congress expanded the Act in the late 1970s by passing the <strong>Pregnancy Discrimination Act of 1978<\/strong>. This Act clarifies that pregnancy discrimination is classed as <strong>unlawful sex discrimination<\/strong>.<\/span><\/p>\n<h3><b>Age Discrimination in Employment Act<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.dol.gov\/general\/topic\/discrimination\/agedisc#:~:text=The%20Age%20Discrimination%20in%20Employment,conditions%20or%20privileges%20of%20employment.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Age Discrimination in Employment Act<\/span><\/a> <span style=\"font-weight: 400;\">(ADEA) is a <strong>federal law<\/strong> that <strong>protects employees and job applicants<\/strong> over the age of 40 from <\/span><a href=\"https:\/\/factorialhr.com\/blog\/age-discrimination-workplace\/\"><span style=\"font-weight: 400;\">age discrimination<\/span><\/a><span style=\"font-weight: 400;\">. This law applies to all aspects of employment, including <strong>hiring, promotion, discharge, compensation, or the terms and conditions of employment<\/strong>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Specifically, the (ADEA) applies to <strong>all U.S. employers with at least 20 employees on their books<\/strong>. It also covers <strong>state and local governments, employment agencies, and labor organizations<\/strong>.\u00a0<\/span><\/p>\n<h3><b>Americans with Disabilities Act<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Finally, the <\/span><a href=\"https:\/\/factorialhr.com\/blog\/americans-with-disabilities-act\/\"><span style=\"font-weight: 400;\">Americans with Disabilities Act<\/span><\/a><span style=\"font-weight: 400;\"> (ADA) was signed into law on<strong> July 26th, 1990<\/strong>. This <strong>federal civil rights law<\/strong> was created to <strong>protect people with disabilities from discrimination in all areas of public life<\/strong>. This includes access to <strong>schools, jobs, and transportation<\/strong>, and any other private place open to the public<strong>.<\/strong>\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Essentially, the ADA <strong>prohibits discrimination on the basis of disability<\/strong> just as other civil rights laws prohibit discrimination on the basis of race, color, sex, national origin, age, and religion. It ensures that <strong>people with disabilities have the same opportunities as everyone else<\/strong> in terms of employment, the purchase of goods and services, and the ability to participate in state and local government programs. \u00a0<\/span><\/p>\n<h2><b><a name=\"Compliance\"><\/a>Workplace Harassment in Florida: Legal Implications and Compliance<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As an employer in The Sunshine State, it\u2019s essential that you understand and <strong>comply with all the state and federal laws aimed at preventing workplace harassment in Florida<\/strong>. The Florida Senate creates policies that prohibit workplace harassment in Florida. The main aim of this state body is to encourage organizations to create a safe and harassment-free workplace.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><strong>The <a href=\"https:\/\/fchr.myflorida.com\/\" target=\"_blank\" rel=\"noopener\">Florida Commission on Human Relations<\/a> and the <a href=\"https:\/\/www.eeoc.gov\/\" target=\"_blank\" rel=\"noopener\">Equal Employment Opportunity Commission (EEOC)<\/a><\/strong><span style=\"font-weight: 400;\"> enforce all laws related to sexual harassment.
