Some employers may allow employees to take the day off as <a href=\"https:\/\/factorialhr.com\/blog\/paid-time-off-usa\/\" target=\"_blank\" rel=\"noopener\">paid<\/a> or <a href=\"https:\/\/factorialhr.com\/blog\/unpaid-time-off\/\" target=\"_blank\" rel=\"noopener\">unpaid time off<\/a>, while others may require employees to work on the holiday.<\/p>\n<h2><strong><a name=\"state\"><\/a>2025 holidays New Jersey: What are the state holidays?<\/strong><\/h2>\n<p>New Jersey celebrates two state holidays in addition to the federal holidays listed above in 2025.<\/p>\n<p><strong>State 2025 holidays New Jersey:<\/strong><\/p>\n<ul>\n<li>Good Friday (observed on April 18th, 2025)<\/li>\n<li>Lincoln&#8217;s Birthday (February 12th)<\/li>\n<\/ul>\n<p><strong>Good Friday<\/strong> is a Christian holiday that commemorates the crucifixion of Jesus Christ. It is observed on the Friday before Easter Sunday.<\/p>\n<p><strong>Lincoln&#8217;s Birthday<\/strong> is a state holiday in New Jersey that commemorates the birthday of Abraham Lincoln, the 16th president of the United States. It is observed on February 12th.<\/p>\n<p><strong>Juneteenth<\/strong> was also observed as a state and public holiday in New Jersey after Phil Murphy signed a bill designating it so in September 2020. For example, public employers can ask employees who work in <strong>essential services,<\/strong> such as law enforcement or healthcare, to work on any of the 2025 holidays in New Jersey and they <strong>do not have to pay them time and a half.<\/strong><\/p>\n<p>Federal employees who do not work on a holiday are typically not paid for it. However, they may be able to use their <strong>accrued vacation or sick leave<\/strong> to cover the day.<\/p>\n<h3>What about state employees?<\/h3>\n<p>The rules for paid and unpaid time off for <strong>state employees<\/strong> in New Jersey <strong>vary depending on the employer.<\/strong> However, in general, state employers in New Jersey typically give employees the day off on federal and state holidays. This <a href=\"https:\/\/www.nj.gov\/nj\/about\/facts\/holidays\/\" target=\"_blank\" rel=\"noopener\">list<\/a> provided by the state of New Jersey outlines exactly what holidays state employees will observe.<\/p>\n<p>Some employers pay state employees for these holidays. The amount of paid vacation leave that private employers offer varies, but it is typically based on the <strong>employee&#8217;s length of service.<\/strong> For example, an employee who has been with a company for 1 year may be eligible for 1 week of paid vacation. An employee who has been with the company for 5 years, in turn, may be eligible for 3 weeks of paid vacation.<\/p>\n<p>In addition to paid vacation leave, some employers also offer <strong>unpaid vacation leave.<\/strong> Unpaid vacation leave is typically available to employees who have been with the company for a certain length of time and who have <strong>accrued a certain amount of paid vacation leave.<\/strong> Employees can use unpaid vacation leave for any reason, such as to take a <strong>personal day<\/strong> or to <strong>care for a sick family member.<\/strong><\/p>\n<p>In contrast to the above, <strong>public employers in New Jersey are required to provide paid vacation leave to their employees.<\/strong> The amount of paid vacation leave varies, but it is typically based on the employee&#8217;s <strong>job classification and length of service.<\/strong> For example, a police officer may be eligible for 3 weeks of paid vacation, while a teacher may be eligible for 2 weeks of paid vacation.<\/p>\n<p>Finally, there are no state laws in New York that regulate <strong>how employees accrue vacation leave.<\/strong> As a result, employers are free to set their own <a href=\"https:\/\/factorialhr.com\/blog\/vacation-payout\/\" target=\"_blank\" rel=\"noopener\">vacation payout<\/a> and <a href=\"https:\/\/factorialhr.com\/blog\/pto-carry-over\/\" target=\"_blank\" rel=\"noopener\">PTO carry over<\/a> policies. For example, some employers may pay out unused vacation leave when an employee terminates their employment, while others may not.<\/p>\n<h3><strong>Family and medical leave<\/strong><\/h3>\n<p>As with other states like <a href=\"https:\/\/factorialhr.com\/blog\/florida-holidays\/\" target=\"_blank\" rel=\"noopener\">Florida<\/a>, California, and Colorado, <strong>New Jersey has its own state family and medical leave law,<\/strong> known as the New Jersey <a href=\"https:\/\/www.jerseycitynj.gov\/common\/pages\/DisplayFile.aspx?itemId=16010996\" target=\"_blank\" rel=\"noopener\">Family Leave Act<\/a> (NJFLA). This <strong>complements the requirements of the federal Family and Medical Leave Act of 1993<\/strong> which established practices for <a href=\"https:\/\/factorialhr.com\/blog\/parental-leave\/\" target=\"_blank\" rel=\"noopener\">parental leave<\/a> and leave for serious health conditions of employees and their family members.<\/p>\n<p>Specifically, the New Jersey Family Leave Act (NJFLA) provides eligible employees with <strong>up to 12 weeks of paid family leave and up to 3 days of paid sick leave per year.<\/strong> You must also provide employees with certain <strong>job protections<\/strong> during this leave, including <strong>protection from discrimination<\/strong> and the right to <strong>return to the same or equivalent job<\/strong> with the same pay, benefits, and seniority. Employers in New Jersey must also <strong>continue paying employee health insurance coverage<\/strong> while they are on leave.<\/p>\n<p><strong>To be eligible for NJFLA leave, employees must:<\/strong><\/p>\n<ul>\n<li>Have worked for their employer for at least 12 months.<\/li>\n<li>Have worked at least 1,250 hours in the previous 12 months.<\/li>\n<li>Be employed by an employer with at least 50 employees.<\/li>\n<\/ul>\n<p><strong>An employee can request NJFLA leave for the following reasons:<\/strong><\/p>\n<ul>\n<li>The birth or adoption of a child.<\/li>\n<li>The placement of a child with the employee for adoption or foster care.<\/li>\n<li>To care for a family member with a serious health condition.<\/li>\n<li>In order to bond with a new child.<\/li>\n<li>To attend a qualifying military event.<\/li>\n<\/ul>\n<h3><strong>New Jersey Earned Sick Leave Law (PSLL)<\/strong><\/h3>\n<p>The New Jersey <a href=\"https:\/\/www.nj.gov\/labor\/worker-protections\/earnedsick\/law.shtml\" target=\"_blank\" rel=\"noopener\">Earned Sick Leave Law<\/a> (PSLL) is a state law that requires employers in New Jersey with <strong>50 or more employees<\/strong> to provide their workers with <strong>up to 40 hours of paid sick leave per year.<\/strong><\/p>\n<p>The PSLL ensures that employees can <strong>take time off for their own illness or injury, the illness or injury of a family member, or to attend a medical appointment for themselves or a family member.<\/strong><\/p>\n<p>Additionally, the PSLL also allows employees to use earned sick leave to:<\/p>\n<ul>\n<li>Care for a newborn or newly adopted child.<\/li>\n<li>Take time off to bond with a new child.<\/li>\n<li>Seek preventive care.<\/li>\n<li>Address issues relating to domestic violence, sexual assault, or stalking.<\/li>\n<\/ul>\n<p>In addition to the above, the PSLL also includes a number of other <strong>important provisions,<\/strong> such as:<\/p>\n<ul>\n<li>Employers cannot<strong> discriminate against employees<\/strong> who take earned sick leave. This means that you cannot fire, demote, or otherwise retaliate against employees who take earned sick leave.<\/li>\n<li>Employees who take earned sick leave must <strong>return to their same or an equivalent job<\/strong> with the same pay, benefits, and seniority. This means that you cannot demote an employee or reduce their pay or benefits when they return from earned sick leave.<\/li>\n<li>Employees who take earned sick leave have a right to <strong>continue their health insurance coverage<\/strong> while they are on leave. This means that you cannot increase employee health insurance premiums while they are on earned sick leave.<\/li>\n<\/ul>\n<h3><strong>Wage and Hour Law<\/strong><\/h3>\n<p>The New Jersey <a href=\"https:\/\/www.nj.gov\/labor\/wageandhour\/tools-resources\/laws\/\" target=\"_blank\" rel=\"noopener\">Wage and Hour Law<\/a> (NJWHL), enforced by the <strong>New Jersey Department of Labor and Workforce Development,<\/strong> sets <strong>minimum wage and overtime pay requirements<\/strong> for employees in New Jersey. The NJWHL also includes provisions on <strong>child labor and recordkeeping.<\/strong><\/p>\n<p>Specific provisions include:<\/p>\n<ul>\n<li>The<strong><a href=\"https:\/\/www.nj.gov\/labor\/lwdhome\/press\/2024\/20241008_minwage.shtml\" target=\"_blank\" rel=\"noopener\"> minimum wage<\/a> starting January 1, 2025 is $15.49 per hour<\/strong> for most employees. The minimum cash wage for<strong> tipped employees<\/strong> will also <strong>increase to $5.62\u00a0<\/strong>which ultimately increases <a href=\"https:\/\/www.nj.gov\/labor\/myworkrights\/worker-protections\/tipped_workers\/\" target=\"_blank\" rel=\"noopener\">tipped employees hourly wage<\/a>.<\/li>\n<li>If employees work more than 40 hours in a week, you must pay them <strong>overtime pay<\/strong> (time and a half).<\/li>\n<li>The NJWHL <strong>prohibits the employment of children under the age of 14<\/strong> in certain occupations.<\/li>\n<li>Employers must <strong>keep records of employee wages and hours worked<\/strong>\u00a0for at least three years.<\/li>\n<\/ul>\n<h3><strong>Equal Pay Act<\/strong><\/h3>\n<p>The New Jersey <a href=\"https:\/\/www.nj.gov\/labor\/wageandhour\/tools-resources\/equal-pay\/\" target=\"_blank\" rel=\"noopener\">Equal Pay Act<\/a> (NJEPA) <strong>prohibits discrimination in pay on the basis of sex.<\/strong> The Act applies to all employers in New Jersey, regardless of their size.<\/p>\n<p>The NJEPA also prohibits employers from <strong>paying employees of the same sex different wages for work that is not substantially similar, but is equal in skill, effort, and responsibility.<\/strong><\/p>\n<p>To determine whether two jobs are substantially similar, the court will consider the following factors:<\/p>\n<ul>\n<li>Job duties<\/li>\n<li>Skill level required<\/li>\n<li>Effort required<\/li>\n<li>Responsibility required<\/li>\n<li>Working conditions<\/li>\n<\/ul>\n<p>The NJEPA does not apply to employees who are exempt from the <strong>Fair Labor Standards Act (FLSA).<\/strong><\/p>\n<h3><strong>Law Against Discrimination<\/strong><\/h3>\n<p>Finally, the New Jersey <a href=\"https:\/\/www.njoag.gov\/about\/divisions-and-offices\/division-on-civil-rights-home\/know-the-law\/#:~:text=The%20LAD's%20prohibition%20against%20discrimination,because%20of%20their%20sexual%20orientation.\" target=\"_blank\" rel=\"noopener\">Law Against Discrimination<\/a> (LAD) is a state law that <strong>prohibits discrimination in employment, housing, and public accommodations on the basis of race, color, religion, sex, national origin, age, disability, or genetic information.<\/strong> The LAD applies to all employers, landlords, and businesses in New Jersey, regardless of their size.<\/p>\n<p>The NJLAD prohibits employers from discriminating against employees <strong>in any aspect of employment,<\/strong> including:<\/p>\n<ul>\n<li>Hiring<\/li>\n<li>Firing<\/li>\n<li>Compensation<\/li>\n<li>Promotion<\/li>\n<li>Training<\/li>\n<li>Benefits<\/li>\n<li>Discipline<\/li>\n<li>Harassment<\/li>\n<\/ul>\n<p>The LAD also <strong>prohibits employers from retaliating against employees<\/strong> who complain about discrimination or who participate in an investigation of discrimination.<\/p>\n<p><a href=\"https:\/\/factorialhr.com\/templates\/pto-tracker-2024\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" class=\"alignnone wp-image-128566\" src=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2023\/11\/01122217\/pto-tracker-template-2-300x103.png\" alt=\"pto tracker template\" width=\"798\" height=\"274\" srcset=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2023\/11\/01122217\/pto-tracker-template-2-300x103.png 300w, https:\/\/factorialhr.com\/wp-content\/uploads\/2023\/11\/01122217\/pto-tracker-template-2-768x263.png 768w, https:\/\/factorialhr.com\/wp-content\/uploads\/2023\/11\/01122217\/pto-tracker-template-2.png 800w\" sizes=\"(max-width: 798px) 100vw, 798px\" \/><\/a><\/p>\n<h2><strong><a name=\"Factorial\"><\/a>Track and report employee time off with Factorial<\/strong><\/h2>\n<p>Factorial&#8217;s <strong>time tracking and reporting features<\/strong> are invaluable tools for employers seeking to <strong>effectively manage employee time off<\/strong> during the 2025 holidays in New Jersey.
