This means further restrictions on public and private life. We are being advised to stay home and avoid contact with others, including loved ones. As such, <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=5nsg6VV6lhY\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">businesses are shutting down offices<\/span><\/a><span style=\"font-weight: 400;\"> so people are prevented from going to their workplace. This can have serious financial repercussions for employers, employees and their families.<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">COVID-19 is presenting employers with a never-before-experienced situation. They are sailing through uncharted waters, not knowing what to do and what will happen in the future. Of course, the safety and livelihoods of their workers are of the utmost importance during this unprecedented time.<\/span><\/p>\n<p><span style=\"font-family: georgia, palatino, serif;\"><span style=\"font-weight: 400;\">Today, we\u2019re going to explore the topic of <\/span><b>emergency paid leave<\/b><span style=\"font-weight: 400;\">. We will also focus on the new measures the US Government is putting in place to support employers and employees alike.\u00a0<\/span><\/span><\/p>\n<ul>\n<li><a href=\"#paidleave\">Emergency Paid Leave<\/a><\/li>\n<li><a href=\"#ffcra\">Families First Coronavirus Response Act<\/a><\/li>\n<li><a href=\"#eligibility\">Eligibility<\/a><\/li>\n<li><a href=\"#exclusions\">Exclusions<\/a><\/li>\n<li><a href=\"#faq\">FAQ Paid Leave<\/a><\/li>\n<\/ul>\n<h2><strong><span style=\"font-family: georgia, palatino, serif;\"><a name=\"paidleave\"><\/a>Emergency Paid Leave\u00a0<\/span><\/strong><\/h2>\n<p><span style=\"font-family: georgia, palatino, serif;\"><span style=\"font-weight: 400;\">In response to the outbreak of COVID-19 and the subsequent effect on employees, the US Congress has recently passed emergency leave legislation. Known as the <\/span><b>Families First Coronavirus Response Act (FFCRA)<\/b><span style=\"font-weight: 400;\">, it contains numerous updates to the country\u2019s current employment regulations.\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">The Act has been created primarily as a means to offer support to anyone affected by the coronavirus. The FFCRA was signed by President Trump on March 18th, 2020 and will come into effect from April 1st, 2020. It will be effective until December 31st, 2020.<\/span><\/p>\n<p><a href=\"https:\/\/factorialhr.com\/holidays-leaves-software\"><img decoding=\"async\" class=\"alignnone wp-image-14875 size-full\" src=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2020\/03\/31111714\/work-life-balance.png\" alt=\"work life balance\" width=\"1300\" height=\"161\" \/><\/a><\/p>\n<h2><strong><span style=\"font-family: georgia, palatino, serif;\"><a name=\"ffcra\"><\/a>Families First Coronavirus Response Act\u00a0<\/span><\/strong><\/h2>\n<p><span style=\"font-family: georgia, palatino, serif;\"><span style=\"font-weight: 400;\">The FFCRA is made up of two components relative to paid leave, namely the <\/span><b>Emergency Family and Medical Leave Expansion Act<\/b><span style=\"font-weight: 400;\"> and the <\/span><b>Emergency Paid Sick Leave Act<\/b><span style=\"font-weight: 400;\">. Under the FFCRA, employees will be entitled to federal emergency paid sick leave before using state or local sick leave or accrued employer-offered paid time off (PTO).\u00a0<\/span><\/span><\/p>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Essentially, this Act calls for employers to provide employees with paid sick leave or family and medical leave. This will be for specified reasons related directly to COVID-19 from its effective date. This new law\u2019s ultimate aim is to offer financial support to those who have been affected by the virus. This will be either, through the closing of the workplace or illness related to COVID-19.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\"><span style=\"text-decoration: underline;\"><a name=\"eligibility\"><\/a>FFCRA Eligibility<\/span>\u00a0<\/span><\/h3>\n<p><span style=\"font-family: georgia, palatino, serif;\"><span style=\"font-weight: 400;\">One question you might be wondering is \u201c<\/span><b>Who is eligible for emergency leave?<\/b><span style=\"font-weight: 400;\">\u201d. Available to employers with 500 employees or fewer, this new law provides workers with two weeks paid sick leave. <strong>Si<\/strong><\/span><b>ck leave is paid out when:<\/b><\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-family: georgia, palatino, serif;\"><b>The employee\u2019s regular rate<\/b><span style=\"font-weight: 400;\"> of pay to a maximum of $511 per day. This is<\/span><b> only if the employee is unable to work because they are quarantined<\/b><span style=\"font-weight: 400;\"> and\/or experiencing COVID-19 symptoms and seeking a medical diagnosis.<\/span><\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-family: georgia, palatino, serif;\"><b>Two-thirds of the employee\u2019s regular rate of pay <\/b><span style=\"font-weight: 400;\">up to a maximum of $200 per day. This applies when the employee is<\/span><b> unable to work due to a need to care for an individual <\/b><span style=\"font-weight: 400;\">subject to quarantine or care for a child. Or when the employee is experiencing substantially similar specified conditions.<\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">A full-time employee is entitled to up to 80 hours of emergency paid leave. Whereas, A part-time employee is entitled to the usual number of hours they work in a normal two-week period.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\"><span style=\"text-decoration: underline;\"><a name=\"exclusions\"><\/a>Exclusions<\/span>\u00a0<\/span><\/h3>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Small businesses with fewer than 50 employees may qualify for an exemption from the requirement to provide leave. However, this would be in the event of school closures or the unavailability of child care. Thus, the leave requirements would jeopardize the viability of the business as a going concern.\u00a0<\/span><\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-48099 size-full\" src=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2020\/04\/12111841\/paid-time-off.jpeg\" alt=\"paid time off\" width=\"795\" height=\"450\" srcset=\"https:\/\/factorialhr.com\/wp-content\/uploads\/2020\/04\/12111841\/paid-time-off.jpeg 795w, https:\/\/factorialhr.com\/wp-content\/uploads\/2020\/04\/12111841\/paid-time-off-300x170.jpeg 300w, https:\/\/factorialhr.com\/wp-content\/uploads\/2020\/04\/12111841\/paid-time-off-768x435.jpeg 768w, https:\/\/factorialhr.com\/wp-content\/uploads\/2020\/04\/12111841\/paid-time-off-688x388.jpeg 688w\" sizes=\"(max-width: 795px) 100vw, 795px\" \/><\/p>\n<h2><strong><span style=\"font-family: georgia, palatino, serif;\"><a name=\"faq\"><\/a>Emergency Leave FAQs\u00a0<\/span><\/strong><\/h2>\n<h4><span style=\"font-family: georgia, palatino, serif;\"><b>How does the FFCRA pay employers?<\/b><\/span><\/h4>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Employers may be wondering how the process of emergency paid leave works. Essentially, the employer pays their employees directly the amount stipulated in the Act. Then, employers covered by the Act qualify for dollar-for-dollar reimbursement through tax credits for all qualifying wages paid under the FFCRA.\u00a0<\/span><\/p>\n<h4><span style=\"font-family: georgia, palatino, serif;\"><b>Can the employee take the leave intermittently?<\/b><\/span><\/h4>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">The FFCRA does not state whether the leave may be taken intermittently. However, the US Department of Labor (DOL)\u00a0 states that intermittent leave is permitted as long as there is an agreement between employer and employee.\u00a0<\/span><\/p>\n<h4><span style=\"font-family: georgia, palatino, serif;\"><b>Do employees have a right to return to their positions after taking leave?<\/b><\/span><\/h4>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Yes. Employers can not fire or refuse to reinstate employees as a result of a leave.\u00a0<\/span><\/p>\n<h4><span style=\"font-family: georgia, palatino, serif;\"><b>What documents should employers request?<\/b><\/span><\/h4>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">The DOL advises employers to collect all documents related to the reason for the absence.<\/span><\/p>\n<h4><strong>If an employee cannot work on-site for a COVID-19 qualifying reason, can they work from home?<\/strong><\/h4>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Yes, but only if the employee is physically able to do so, otherwise a FFCRA benefit claim cannot be obtained. Reasons must be given by the employee when determining whether they are able to <a href=\"https:\/\/factorialhr.com\/blog\/work-from-home-optimize-home-office\/\" target=\"_blank\" rel=\"noopener noreferrer\">work remotely<\/a> or not.\u00a0<\/span><\/p>\n<h4><span style=\"font-family: georgia, palatino, serif;\"><b>What are the leave requirements?<\/b><\/span><\/h4>\n<p><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">The coronavirus response act provides workers with paid sick time if they are unable to work, either in the office or remotely. This is because they:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Are subject to quarantine or isolation related to COVID-19<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Have been advised by a health care provider to self-quarantine<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Are showing symptoms and seeking a medical diagnosis<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Need to take care of an individual who has been ordered or advised to self-quarantine<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Must care for their child if the school or childcare facility has been closed or the childcare provider is unavailable<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">Are experiencing any other substantially similar condition determined by the secretary of Health and Human Services in consultation with the Secretary of the Treasury and the Secretary of Labor<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400; font-family: georgia, palatino, serif;\">For more information\u2026<\/span><\/h2>\n<p><span style=\"font-family: georgia, palatino, serif;\"><span style=\"font-weight: 400;\">The DOL has issued guidance on compliance with the rules and regulations stipulated under the FFCRA.
