It is known as bereavement leave grievance leave or <\/span><span style=\"font-weight: 400;\">compassionate leave<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p><strong>Bereavement is the period of mourning after the death of a loved one<\/strong><span style=\"font-weight: 400;\"><strong>.<\/strong> It is typical during this time for people to experience grief.\u00a0<\/span><span style=\"font-weight: 400;\">In this case, it is common for employees to ask for time off work in order to grieve at home alone or with family. Not only this, but employees may have to deal with a whole host of tasks including <\/span><span style=\"font-weight: 400;\">funeral arrangements<\/span><span style=\"font-weight: 400;\"> and other pressing post-death matters. Time taken away from work to deal with these matters is commonly known as <\/span><span style=\"font-weight: 400;\">bereavement time off.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p><b>As an employer, it&#8217;s important to know how to best support your employees during those difficult times.<\/b><\/p>\n<h3><strong>Bereavement vs Funeral Leave<\/strong><\/h3>\n<p>Some employers may differentiate between \u201cfuneral leave\u201d and \u201cbereavement leave.\u201d The exact language will depend on the company\u2019s policy. Employees should check their contract or employee handbook to see what applies to them.<\/p>\n<ul>\n<li><strong>Funeral Leave <\/strong>is usually two or three days off. Employers expect that employees will use this time to attend a funeral. Some employees may be able to take funeral leave for someone who isn\u2019t immediate family.<\/li>\n<li><strong>Bereavement Leave <\/strong>is usually a week or two of time off. Workers use this time to make arrangements, attend a funeral, and mourn. Some employers might expect workers to use accrued sick time, <a href=\"https:\/\/factorialhr.com\/blog\/floating-holiday\/\" target=\"_blank\" rel=\"noopener\">floating holidays<\/a>, or <a href=\"https:\/\/factorialhr.com\/blog\/personal-time-off\/\" target=\"_blank\" rel=\"noopener\">personal time off<\/a> rather than offering this kind of leave.<\/li>\n<\/ul>\n<p>In the eyes of the law, funeral leave would fall under the umbrella of bereavement.\u00a0<b><\/b><br \/>\n<a name=\"history\"><\/a><\/p>\n<h2><strong>Bereavement Leave California: A History<\/strong><\/h2>\n<p>Bereavement leave in California has been a long time coming. The first legislation mandating bereavement leave appeared (but did not pass) in 2007. Now, 15 years later, Assembly Bill 1949 has passed, ensuring leave to most California employees who have lost loved ones.<\/p>\n<p>In 2007, Senator Corbett introduced a measure that would have provided all California employees with <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=200720080SB549\" target=\"_blank\" rel=\"noopener noreferrer\">four days off for bereavement<\/a>. Governor Schwarzenegger vetoed the measure, and in 2010, vetoed another that proposed three days of leave. Governor Brown vetoed a similar measure in 2011.<\/p>\n<p class=\"rtejustify\">Other than California, very few states have bereavement leave laws in place. Oregon, Illinois and Maryland have laws in place that cover private employers.<\/p>\n<p>Before AB 1949, <strong>private sector employers<\/strong> did not have to provide bereavement leave in CA, either paid or unpaid. If they wished to take time off to make funeral arrangements or mourn, they could use accrued time off or compensatory time. Although the law did not oblige employers to offer bereavement leave, some may have included bereavement in their company leave policy.<\/p>\n<p>Public employees were entitled to up to three days of paid bereavement leave. California state employees had to provide documentation of bereavement leave, such as a death certificate or obituary. If the death was out of state, the employee could take two additional unpaid days off.<br \/>\n<a name=\"law-ab-1949\"><\/a><\/p>\n<h2><strong>Bereavement Leave California: AB 1949<\/strong><\/h2>\n<p>Despite the battle, <strong>bereavement leave became protected when Governor Newsom signed Assembly Bill 1949<\/strong> at the end of September 2022. The bill created protects the leave under the California Family Rights Act (CFRA) and <strong>went into<\/strong> <strong>effect on January 1, 2023.<\/strong><\/p>\n<p>Qualifying employees, of private-sector employers with at least five employees and all public-sector employers, <strong>will be given five days of bereavement leave.<\/strong> Employers and HR teams alike should be aware of the requirements for qualifying employees.<\/p>\n<h3 class=\"p-rich_text_section\">Bereavement leave eligibility<\/h3>\n<p class=\"p-rich_text_section\">There are a few requirements under AB 1949:<\/p>\n<ul class=\"p-rich_text_list p-rich_text_list__bullet\" data-stringify-type=\"unordered-list\" data-indent=\"0\" data-border=\"0\">\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">The employee needs to have been\u00a0<b data-stringify-type=\"bold\">employed for at least 30 days prior<\/b> to the start of the leave. The leave needs to be for a qualifying family member.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\"><b data-stringify-type=\"bold\">A qualifying member may be: <\/b>a spouse, parent, child, sibling, grandparent, domestic partner, or parent-in-law.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\"><b data-stringify-type=\"bold\">There is no limit<\/b> for how many times an employee can take the leave as long as it is for a qualifying family member.<\/li>\n<li>The five days covered for qualifying employees\u00a0<b data-stringify-type=\"bold\">do not need to be taken consecutively.<\/b>\u00a0However, the bereavement leave needs to be taken\u00a0<b data-stringify-type=\"bold\">within three months of the date of death.<\/b><\/li>\n<\/ul>\n<h3 class=\"p-rich_text_section\">Employer takeaways under AB 1949<b data-stringify-type=\"bold\"><\/b><\/h3>\n<ul class=\"p-rich_text_list p-rich_text_list__bullet\" data-stringify-type=\"unordered-list\" data-indent=\"0\" data-border=\"0\">\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">To know whether the leave under AB 1949 is paid or unpaid depends solely <b data-stringify-type=\"bold\">on an employer\u2019s current policy.<\/b><\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">Employers\u00a0<b data-stringify-type=\"bold\">may require documentation<\/b>\u00a0for the employee\u2019s bereavement leave. This could include: a published obituary, verification of death, death certificate, or memorial services documentation. If requested by the employer,\u00a0<b data-stringify-type=\"bold\">documentation must be provided within 30 days of said leave.<\/b><\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\"><b data-stringify-type=\"bold\">Confidentiality<\/b>\u00a0of employee and documentation\u00a0<b data-stringify-type=\"bold\">must be maintained<\/b>\u00a0under AB 1949.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">Under AB 1949,\u00a0<b data-stringify-type=\"bold\">employers cannot<\/b>\u00a0<b data-stringify-type=\"bold\">refuse to hire, discharge, demote, fine, suspend, expel, or discriminate<\/b>\u00a0against any person who exercises their right to bereavement leave or any person who provides testimony regarding their own bereavement leave or another person\u2019s in an inquiry or proceeding related to rights guaranteed under AB 1949.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">If an employer does not already have a policy, the five days permitted under AB 1949 may be unpaid. However, employees can use accrued paid time off.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\"><strong>An employer with an existing paid policy<\/strong> will continue to provide employees with those paid days. If the existing policy <strong>is less than five, any remaining days under AB 1949 will be unpaid<\/strong>. However, employees can use any accrued time off to cover remaining days that are unpaid.<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\"><strong>Employers who have an existing bereavement leave policy of less than five days<\/strong> will adopt the five day requirement under AB 1949 and can use any accrued time off to cover those<\/li>\n<li data-stringify-indent=\"0\" data-stringify-border=\"0\">If the employer\u2019s existing leave policy provides <strong>for less five days of\u00a0<i data-stringify-type=\"italic\">unpaid<\/i>\u00a0bereavement leave<\/strong>, the employee is entitled to at least five days of unpaid leave; however, the employee may use accrued paid leave otherwise available to the employee for the unpaid days.<\/li>\n<\/ul>\n<p><a name=\"fmla-bereavement\"><\/a><\/p>\n<h2><strong>FMLA and Bereavement Leave in California<\/strong><\/h2>\n<p>The<strong> <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/fmla\" target=\"_blank\" rel=\"noopener noreferrer\">Family and Medical Leave Act<\/a> (FMLA)<\/strong> is a federal law that guarantees workers around the country 12 weeks of <a href=\"https:\/\/factorialhr.com\/blog\/unpaid-time-off\/\" target=\"_blank\" rel=\"noopener noreferrer\">unpaid time off<\/a>. FMLA only covers businesses that are larger than 50 employees, and only applies to employees who have worked at least a year for their employer. If they qualify, employees can use this time off for:<\/p>\n<ul>\n<li>The birth and care of a newborn child or placement of an adopted or foster child.<\/li>\n<li>Caring for an immediate family member.<\/li>\n<li><a href=\"https:\/\/factorialhr.com\/blog\/intermittent-leave\/\" target=\"_blank\" rel=\"noopener noreferrer\">Medical or intermittent leave<\/a> if an employee is unable to work.<\/li>\n<\/ul>\n<p><strong>Can you apply FMLA for bereavement leave?<\/strong> Under the current law, an employee cannot use FMLA job-protected leave to attend a funeral or make arrangements for someone who has passed. Employees may receive time off to care for family members, but once the family member passes, employees technically no longer qualify for leave.<br \/>\n<a name=\"cfra-leave-cali\"><\/a><\/p>\n<p><em><strong>Related: <a href=\"https:\/\/factorialhr.com\/blog\/california-employment-laws\/\" target=\"_blank\" rel=\"noopener\">California Employment Laws Explained<\/a><\/strong><\/em><\/p>\n<h2><strong>CFRA and Leave in California<\/strong><\/h2>\n<p>The <strong><a href=\"https:\/\/www.dfeh.ca.gov\/employment\/pdl-cfra-npla-fmla\/\" target=\"_blank\" rel=\"noopener noreferrer\">California Family Rights Act<\/a> (CFRA)<\/strong> mirrors FMLA, offering 12 weeks of unpaid leave to employees. It also stipulates that employees can receive up to six weeks of Family Temporary Disability Insurance (FTDI) over a 12-month period. Employers need to track time off in order to make sure that they are in compliance with federal and local regulations. California already offers some of the most comprehensive unpaid and <a href=\"https:\/\/factorialhr.com\/blog\/paid-time-off-usa\/\" target=\"_blank\" rel=\"noopener noreferrer\">paid time off laws<\/a> in the country.
