It is important to note that these standards are applicable only to some businesses. <a href=\"https:\/\/www.youtube.com\/watch?v=UdbF182f6GQ\" target=\"_blank\" rel=\"noopener noreferrer\">HIPAA compliance<\/a>\u00a0is important for \u201ccovered entities\u201d such as private and public healthcare providers, health insurance companies, and HMOs\u2014 as well as any businesses which negotiate with them.<\/p>\n<p style=\"text-align: left;\">Non-compliance with HIPAA can lead to serious fines. Even small HIPAA violations can cost businesses between $100 and $50,000 per transgression. If the app does not share information with a covered entity, then the app or device does not have to be HIPAA compliant.<\/p>\n<p>When it comes time for employees to register with workplace-organized health insurance, they should give their information directly to the insurance company. That way, the integrity of their PHI will not be compromised.<\/p>\n<h2><a name=\"privacy\"><\/a><strong>HIPAA Privacy Rule &amp; HIPAA Security Rule<\/strong><\/h2>\n<p>In order to be in compliance with HIPAA, businesses carefully evaluate the tools they use to transmit PHI. They should keep in mind the following HIPAA rules<\/p>\n<ul>\n<li><a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/security\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">The HIPAA Security Rule<\/a> was added to set out what safeguards must be in place to protect electronic PHI (ePHI), which is health information that is held or transferred in electronic form.<\/li>\n<li><a href=\"https:\/\/privacyruleandresearch.nih.gov\/pr_04.asp\" target=\"_blank\" rel=\"noopener noreferrer\">The Privacy Rule<\/a> allows covered entities to disclose PHI to a Business Associate if they receive assurances that the Business Associate will use the information only in the scope of which it was engaged by the covered entity.<\/li>\n<\/ul>\n<p style=\"padding-left: 40px;\">If you using a third party to transmit or host PHI, they are required by law to sign a <a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/covered-entities\/sample-business-associate-agreement-provisions\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Business Associates Agreement<\/a> (BAA). This ensures that adequate administrative, physical, and technical safeguards are in place.<\/p>\n<ul>\n<li><a href=\"https:\/\/www.hhs.gov\/hipaa\/for-professionals\/breach-notification\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Breach Notification Notification Rule<\/a> stipulates the actions that covered entities or business associates must take following a breach of a data breach of PHI or ePHI. Software that is HIPAA compliant will have technical, physical, and administrative safeguards to protect against unauthorized leaks.<\/p>\n<ul>\n<li><strong>Administrative Safeguards<\/strong> ensure that the administrators and developers who have access to ePHI act responsibly. This means training employees about the ethical and legal implications of their work. Safeguards may include:\n<ul>\n<li>Information Access Management<\/li>\n<li>Workforce Training<\/li>\n<li>Risk Analysis<\/li>\n<\/ul>\n<\/li>\n<li><strong>Physical Safeguards<\/strong> prevent data breaches by limiting the personnel who have access to the facilities and machines where ePHI is stored. Physical safeguards may include:\n<ul>\n<li>Security Personnel<\/li>\n<li>Workstation Management<\/li>\n<li>Facility and Access Control Policies<\/li>\n<\/ul>\n<\/li>\n<li><strong>Technical Safeguards<\/strong> concern the software and technologies used to protect ePHI. ePHI must be encrypted according to the standards of the <a href=\"https:\/\/www.nist.gov\/programs-projects\/security-health-information-technology\/hipaa-security-rule#:~:text=NIST%20published%20%22An%20Introductory%20Resource,security%20requirements%20adopted%20by%20the\" target=\"_blank\" rel=\"noopener noreferrer\">National Institute of Standards and Technology<\/a> so that confidential patient data is unreadable, undecipherable, and unusable. The law does not specify the exact technologies needed but indicates a need for:\n<ul>\n<li>Access Controls<\/li>\n<li>Integrity Controls<\/li>\n<li>Audit Controls<\/li>\n<li>Transmissions Security<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>Not all software meets these high standards. Some software only need tweaks to meet the criteria. In the following sections, we\u2019ll walk you through the most-commonly-used software and tell you what to avoid.<\/p>\n<h2><strong><a name=\"software\"><\/a>Software for HIPAA Compliant Telehealth<\/strong><\/h2>\n<p>In the age of COVID, telehealth has become increasingly common. What are the best tools for video conference HIPAA compliance?<\/p>\n<ul>\n<li>Is Zoom HIPAA compliant? <a href=\"https:\/\/zoom.us\/docs\/doc\/Zoom-hipaa.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Zoom<\/a>\u2019s free and regular paid versions are not HIPAA compliant, but it offers a healthcare option for covered entities. In this version, Zoom applies mandatory settings so that while the software transmits PHI, it does not have access to the data. Zoom also authenticates log-ins and encrypts chats.<\/li>\n<li>What about Skype? The free version of Skype is not <strong>HIPAA compliant<\/strong>. Skype for Business Enterprise E3 and E5 packages may be HIPAA as long as the businesses sign a BAA with Microsoft. It offers HIPAA-compliant forms like a BAA for businesses to sign.<\/li>\n<li>Video platform Webex can be HIPAA compliant so long as businesses sign a BAA <a href=\"https:\/\/blogs.cisco.com\/collaboration\/protecting-your-webex-healthcare-data\" target=\"_blank\" rel=\"noopener noreferrer\">with parent company Cisco<\/a>.<\/li>\n<\/ul>\n<h2><a name=\"emails\"><\/a><strong>How to send HIPAA Compliant Emails and Document Sharing<\/strong><\/h2>\n<p>When sending out sensitive information, HIPAA compliant email is vital for protecting client information and ePHI. What platforms offer the right protection?<\/p>\n<ul>\n<li>While the free version of G Suite does not comply with HIPAA, the paid version does so long as users review and accept a BAA. <a href=\"https:\/\/services.google.com\/fh\/files\/misc\/gsuite_cloud_identity_hipaa_implementation_guide.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">G Suite<\/a> administrators will also have to toggle some settings to make sure the integrity of data is not compromised.<\/li>\n<li>Slack users will be happy to know that with the implementation of specific controls and a BAA, <a href=\"https:\/\/a.slack-edge.com\/80588\/marketing\/downloads\/security\/Slack_HIPAA-Compliance.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Slack<\/a> can also be HIPAA compliant.<\/li>\n<li>Is Asana a HIPAA-compliant cloud service? No! While Asan offers integrations with tools such as <a href=\"https:\/\/www.box.com\/industries\/healthcare\/hipaa-compliance#:~:text=The%20Box%20platform%20and%20associated,store%20PHI%20in%20the%20cloud.\" target=\"_blank\" rel=\"noopener noreferrer\">Box<\/a>, which do comply with HIPAA, Asana itself is not suitable for PHI.<\/li>\n<li>Dropbox can be HIPAA compliant, as long as the business\u2019s account is correctly configured and a BAA exists.<\/li>\n<\/ul>\n<h2><strong>Finding the Right HIPAA Compliant Tools<\/strong><\/h2>\n<p>This may seem a little complicated but don\u2019t be intimidated!
