What\u2019s the best approach in this scenario?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are a few strategies you can include in your time-off policy to address this. You could <\/span><b>prioritize senior members of staff<\/b><span style=\"font-weight: 400;\">, but this leaves you open to claims of favoritism and discrimination. Whatever perk you offer, it should <\/span><a href=\"https:\/\/factorialhr.com\/blog\/tips-motivate-employee-xmas\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">motivate your employees<\/span><\/a><span style=\"font-weight: 400;\"> and make them feel that you appreciate them working over the holidays.\u00a0<\/span><\/p>\n<h2><b>Stay compliant<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">One of the most important aspects of your time off policy is making sure it is <\/span><b>HR compliant<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whatever your time off policy is, it needs to comply with the <\/span><a href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Fair Labor Standards Act <\/span><\/a><span style=\"font-weight: 400;\">(FLSA). The first thing to consider is whether your employees are exempt or non-exempt from the obligations detailed in the FLSA.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example, an hourly employee is considered <\/span><b>non-exempt<\/b><span style=\"font-weight: 400;\">, so you only have to pay them for the hours that they work. In this scenario, you are not legally required to offer <\/span><b>paid time off<\/b><span style=\"font-weight: 400;\">. However, if your employees perform <\/span><b>executive, administrative, and professional dutie<\/b><span style=\"font-weight: 400;\">s, then they are classed as <\/span><b>exempt<\/b><span style=\"font-weight: 400;\">. And this means that you have to pay them their salaries regardless of hours clocked. If you don\u2019t, then you risk legal liability for non-compliance with federal law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So, what does this mean in terms of paid or unpaid time off?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Essentially, although there is no legal obligation to offer paid or <\/span><a href=\"https:\/\/factorialhr.com\/blog\/personal-time-off\/\"><span style=\"font-weight: 400;\">personal time off<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><b>most companies offer a predetermined amount of PTO to exempt employees<\/b><span style=\"font-weight: 400;\"> which includes absences for vacations.
