LEGAL TERMS FOR PARTICIPATION IN THE PRIZE DRAW [Avva Experience Team-Building].
1. Organizing Company:
Everyday Software, S.L. (Factorial HR), a Spanish company with address at Carrer d'Àlaba, 61, 5-2, 08005 Barcelona, Spain and CIF B-66854530 organizes the Drawing of one virtual team-building voucher worth $300 in accordance with the participation requirements.

2. Territorial scope of the lottery:
The territorial scope of this lottery is the territory USA.
3. Drawing start date:
The Drawing will begin on [03/18/2024] at [17:00 CET] and end on [04/01/2024] at [17:00 CET]
Notwithstanding the above, Factorial HR reserves the right to close the Drawing at an earlier date based on the number of responses received.
4. Participation requirements:
The requirements for participation are as follows:
- Be residents of the USA.
- Be of legal age according to the applicable regulations.
- Have correctly filled in all the required fields of the participation form.
- To be part of an enterprise, company or legal entity, regardless of the position or role held in the same.
- Only one participation per person is allowed.
Participation in the Drawing is prohibited to owners, shareholders or members of Factorial HR (including management personnel, employees or subcontractors), especially those who have participated directly in the development and management of this Drawing, their spouses, ascendants or descendants in the second degree or persons living with them.
5. Celebration of the raffle and gift:
All participants must fill in the respective form through the platform [https://factorialhr.com/enter-team-building-prize-draw]. The fields to be filled in will include:
- Name and surname
- Company name
- E-mail address
- Phone
- Job title or position
- Number of company employees
After the deadline for participation in the Drawing, one participant will be randomly selected from the participants.
Participants, by the mere fact of participating in the Drawing, are already accepting the legal bases of the same.
The winning participants will be informed, at the latest, on 04/14/2024 via the email address provided by the participant in the participation form. In the event that any of the selected participant/s do not respond within 04/30/2024 from the communication by Factorial HR, a second round of random selection will be carried out, without including said participant/s. If, after this second round, the new selected participant/s still do not respond within the same period of 2 weeks from the attempt to contact him/her, Factorial HR will consider that/those gift/s as void.
Once the final winning participants are defined, Factorial HR will email the winner privately.
The gift that will be delivered to the winning participant through the email provided initially will consist of a $300 voucher for virtual team-building with Avva Experience. The gift is personal and non-transferable and cannot be exchanged for cash or any other gift, nor can it be exchanged or altered.
The celebration of the Drawing, as well as the awarding of the gift are subject to the tax regulations in force.
6. Disqualifications and penalties:
Completion of multiple entries will result in disqualification from the Drawing.
Providing false, incorrect or fraudulent personal information will result in disqualification from this Drawing.
If it becomes evident that any of the Participants do not comply with the requirements established in the Rules or their participation will be considered null and void and they will be automatically excluded from the Drawing and will lose all rights to the gifts awarded by virtue of this Drawing.
7. Exemption from liability:
By way of example, but not limited to, Factorial HR is not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Drawing, nor is it responsible for the use made by the Participant with respect to the gift obtained from this Drawing.
Factorial HR also assumes no responsibility in cases of force majeure or fortuitous event, epidemics, pandemics, which could prevent the realization of the Drawing or the total or partial enjoyment of the gift.
8. Protection of personal data
In accordance with current data protection regulations Factorial HR would like to inform you that in the context of this Drawing it will act as data controller and will process your data in accordance with the following purposes:
- Manage your participation in the Drawing.
- Contact you to inform you that you have been randomly selected as the winner and recipient of the gift.
- In case you have consented through the respective box, contact you by different means to contact you with marketing purposes and inform you of news about products and services of Factorial HR.
The basis of legitimacy for the processing of your data will be the need to execute the present legal bases. As for the purpose of electronic commercial communications, we will only process your data based on your consent.
The main recipients of your data may be government agencies and administrations, insofar as we are legally obliged to do so, and service companies, such as tax advisors or lawyers, who will not process your personal data for their own purposes under any circumstances.
The data processed by Factorial HR is hosted in the EU and processed within the EU or in the third country that the European Commission considers that offers an adequate level of security. Occasionally, some of our service providers may be located outside the EEA or EU territory. In such an event Factorial HR guarantees to have implemented appropriate safeguards to protect the privacy and security of your personal data. For example, Factorial HR, may have entered into binding agreements that fully comply with the legality of transfers to third countries and, if necessary.
In the context of this Drawing your data will be retained for the duration of the Drawing. If you have consented to receive commercial communications, your data will be processed until you revoke your consent. Once the Drawing has ended or you have revoked your consent, your data will be kept properly blocked for a period of time necessary to deal with possible legal responsibilities. At the end of this period, your data will be definitively destroyed.
You have certain rights regarding data protection. In this regard, you may revoke your consent at any time. To inquire about any data protection issues or exercise your rights, you may send a written communication to the following e-mail address: privacy@factorial.co. In some cases, the request may be denied if the deletion of data necessary for the fulfillment of legal obligations is requested. In addition, we inform you that you have the right to lodge any complaint regarding data protection with the competent Supervisory Authority.

9. Modification
Factorial HR reserves the right to modify or extend these legal bases, to the extent that it does not prejudice or undermine the rights of the Participants, unless its prior authorization is obtained.
The mere fact of participating in the Drawing implies that the Participant fully accepts the conditions of these Terms and Conditions.
10. Applicable Law and Jurisdiction
To the extent permitted by applicable law, these terms and conditions shall be governed in accordance with Spanish law and the Courts and Tribunals of the city of Barcelona. They will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfillment of these rules.
