PARTICIPATION IN AMAZON VOUCHER GIVEAWAY - AI SURVEY
LEGAL TERMS AND CONDITIONS
1. Organizing Entity
The campaign is organized by Everyday Software, S.L. (Factorial), a Spanish company with its registered office at Carrer d'Àlaba, 61, 5-2, 08005 Barcelona, Spain, and CIF B-66854530.
2. Campaign Dates
The campaign will begin on JULY 16th at 09:00 (CET) and end on JULY 25th at 15:00 (CET). Factorial reserves the right to close the campaign early based on the number of nominations received.
The campaign will be carried out in accordance with the provisions of the participation requirements section of these legal terms and conditions.
3. Participation Requirements
The general requirements for participation are as follows:
- 18 years of age or older at the time of entry.
- Finishing the Factorial AI Survey via the Typeform platform.
- Accept the legal and privacy terms and conditions governing this campaign.
4. Selection and Prizes
The Factorial team will conduct an AI Usage Survey for its clients, which they will be able to access via a link provided by email. During the period mentioned in section 2, all participants must complete the Survey via the Typeform platform.
All mandatory fields from the survey must be completed, including accurate contact information.
At the end of the survey, participants must accept the legal terms and conditions of the campaign and authorise Factorial to contact them for advertising purposes.
- Acceptance of the legal terms and conditions and privacy policy.
- Specific acceptance to receive advertising communications.
Once the survey has been completed, all participants will be eligible for the following prize:
One out of four Amazon vouchers for a value of 100 EUR each.
The winners will be selected using the online platform Simpliers (www.simpliers.com), which guarantees the transparency and accuracy of the giveaway.
The winners will be contacted using the information provided in the Typeform. If a winner does not respond within 7 days, an alternate may be selected.
Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash or other goods/services.
5. Disqualifications and Penalties
Completing multiple entries will result in disqualification from the campaign. Providing false, incorrect, or fraudulent personal data will result in disqualification from this campaign.
If it is found that any of the participants do not meet the requirements set out in the Terms and Conditions, their participation will be considered null and void and they will be automatically excluded from the prize campaign, losing all rights to the prizes awarded under this prize campaign.
6. Limitation of Liability
Factorial is not responsible for any lost, stolen, delayed, or misdirected nominations or other circumstances beyond its control that may affect the campaign’s participation process. Factorial is not liable for the use or misinterpretation of the prize by the winner.
Factorial is also not liable in cases of force majeure or unforeseen circumstances, such as pandemics or other events, that may impact the campaign or limit the enjoyment of the prize.
7. Personal Data Protection
In accordance with the applicable data protection regulations, specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR),
Factorial informs you that, within the framework of the Campaign, it will act as the data controller and will process your data for the following purposes:
- Managing your participation in the campaign;
- Contacting you to inform you if you have been selected as a recipient of the reward;
- Send a survey to understand user experience regarding the benefits received from participating in the campaign.
The legal basis for processing your data is the necessity to execute these legal terms and conditions. In the case of the survey, the processing will be based on legitimate interest.
The main recipients of your data may include government bodies and public administrations to the extent that we are legally required to disclose such information. Additionally, service providers such as tax advisors or legal consultants may process data strictly for the necessary purposes, without using them for their own interests.
The data processed by Factorial is hosted within the European Union and is processed either within the EU or in a third country that the European Commission has deemed to provide an adequate level of security. In some cases, certain service providers may be located outside the European Economic Area (EEA) or the EU. In such cases, Factorial ensures that appropriate safeguards are in place to protect the privacy and security of your personal data. In the context of the Campaign, your data will be retained for the duration of the campaign. Once the Campaign ends, your data will be securely stored in a restricted-access format for the necessary period to address potential legal liabilities. After this period, your data will be permanently deleted.
You have certain rights regarding the processing of your personal data. Specifically, you have the right to object to your data being used for sending surveys. 8. Modifications
Factorial reserves the right to modify or extend these legal terms and conditions, provided that this does not adversely affect or undermine the rights of Participants, unless their prior authorisation is obtained.
By participating in the giveaway, participants fully accept the conditions set out in these Legal Terms and Conditions.
9. Applicable Law and Jurisdiction
These Terms and Conditions are governed by Spanish law, and any disputes arising from the interpretation or fulfillment of these conditions shall be subject to the jurisdiction of the courts of Barcelona, Spain.
