PARTICIPATION IN AMAZON VOUCHER GIVEAWAY

1. Organizing Entity

The campaign is organized by Everyday Software, S.L. (Factorial), a Spanish company with its registered office at Carrer de la Llacuna, 56, Ground floor reception, Building C, Sant Martí, 08005 Barcelona, Spain, and CIF B-66854530.

2. Campaign Dates

The campaign will begin on DECEMBER 19th at 12:00 (CET) and end on JANUARY 9th at 18:00 (CET). Factorial reserves the right to close the campaign early based on the number of nominations received.

The winners will be announced on JANUARY 12th.

The campaign will be carried out in accordance with the provisions of the participation requirements section of these legal terms and conditions.

3. Participation Requirements

The general requirements for participation are as follows:

• 18 years of age or older at the time of entry.
• Finishing the Factorial Survey via the Typeform platform.
• Accept the legal and privacy terms and conditions governing this campaign.
• Be a current client of Factorial
• Just one participation per person

Owners, shareholders, or members of Factorial (including management, employees, or subcontractors), especially those who have been directly involved in the preparation and management of this draw, their spouses, ascendants, or descendants in the second degree, or persons living with them, are prohibited from participating.

4. Selection and Prizes

The Factorial team will conduct a Customer Insights Survey for its clients, which they will be able to access via a link provided by email. During the period mentioned in section 2, all participants must complete the Survey via the Typeform platform.

All mandatory fields from the survey must be completed, including accurate contact information.

The information filled out shall be:

• Personal information:

First name

Last name(s)

Work email address

• Corporate information:

Company name

Industry

Number of employees

At the end of the survey, participants must accept the legal terms and conditions of the campaign and authorise Factorial to contact them for advertising purposes.

• Acceptance of the legal terms and conditions and privacy policy.
• Specific acceptance to receive advertising communications.

Once the survey has been completed, all participants will be eligible for the following prize:

One out of five Amazon vouchers for a value of 200 EUR each.

The winners will be selected using the online platform Simpliers (www.simpliers.com), which guarantees the transparency and accuracy of the giveaway.

The winners will be contacted using the information provided in the Typeform. If a winner does not respond within 7 days, an alternate may be selected by doing another draw, excluding the previously chosen person. If the new nominee also fails to respond under the same conditions, Factorial will declare that prize void. 

Factorial shall get in touch with the winner via e-mai,l and the prize shall also be sent directly to the e-mail indicated in the survey. 

Prizes are non-transferable, non-exchangeable, and cannot be redeemed for cash or other goods/services.

The drawing of the prize, as well as the awarding of the gift, are subject to current tax regulations.

5. Disqualifications and Penalties

Completing multiple entries will result in disqualification from the campaign. Providing false, incorrect, or fraudulent personal data will result in disqualification from this campaign.

If it is found that any of the participants do not meet the requirements set out in the Terms and Conditions, their participation will be considered null and void, and they will be automatically excluded from the prize campaign, losing all rights to the prizes awarded under this prize campaign.

6. Limitation of Liability

Factorial is not responsible for any lost, stolen, delayed, or misdirected nominations or other circumstances beyond its control that may affect the campaign’s participation process. Factorial is not liable for the use or misinterpretation of the prize by the winner.

Factorial is also not liable in cases of force majeure or unforeseen circumstances, such as pandemics or other events, that may impact the campaign or limit the enjoyment of the prize.

7. Personal Data Protection

According to current data protection regulations, specifically Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights, Factorial informs you that it will act as data controller in this Contest and will process your data according to the following purposes:

• Manage your participation in the Contest.
• Contact you in case you have been randomly selected as a winner and beneficiary of the prize.
• If you have consented through the respective checkbox, contact you by electronic means to inform you of news about Factorial's products and services.
• If you have consented, capture and use images taken during the Contest for public dissemination and promotion through Factorial's usual external channels, including social networks, websites and to carry out communication or marketing actions related to the contest and the Factorial brand.

The legal basis for processing your data will be the execution of these legal terms. Regarding the additional purposes of capturing and using your image, as well as for electronic commercial communications, we will only process your data based on your consent.

The main recipients of your data may be government bodies and administrations, to the extent that we are legally obliged to do so, and service providers, such as tax advisors or lawyers, who will not in any case process your personal data for their own purposes.

Data processed by Factorial is hosted in the EU and processed within the EU or in third countries that the European Commission considers to offer an adequate level of security. Occasionally, some of our service providers may be located outside the EEA or EU territory. In such cases, Factorial guarantees having applied adequate safeguards to protect the privacy and security of your personal data. For example, Factorial may have signed binding agreements that fully comply with the legality of transfers to third countries and, if necessary.

In the context of this Contest, your data will be retained for the duration of the same. If you have consented to the recording and use of your image, we will process such data for the agreed period and until you revoke your consent. As long as you have consented to receive commercial communications, your data will be processed until you revoke your consent. Once the Contest ends or after you have revoked your consent, your data will be kept properly blocked for a period of time necessary to be able to face possible legal responsibilities. Once this period ends, your data will be permanently destroyed.

You have certain rights regarding data protection. In this regard, you can revoke your consent at any time. To consult any question about data protection or exercise your rights, you can send a written communication to the following email address: [email protected]. In some cases, the request may be denied if the deletion of data necessary for compliance with legal obligations is requested. Additionally, we inform you that you have the right to file any complaint regarding data protection with the competent Supervisory Authority, in this case the Spanish Data Protection Agency.

8. Modifications

Factorial reserves the right to modify or extend these legal terms and conditions, provided that this does not adversely affect or undermine the rights of Participants, unless their prior authorisation is obtained.

By participating in the giveaway, participants fully accept the conditions set out in these Legal Terms and Conditions.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law, and any disputes arising from the interpretation or fulfillment of these conditions shall be subject to the jurisdiction of the courts of Barcelona, Spain.
